These terms apply when you use the OTHERWHEN website or purchase from our store. References to “OTHERWHEN”, “we”, “us” and “our” mean the business operating this store under the OTHERWHEN brand. Our store is hosted by Shopify.
Please read these terms together with our Return and refund policy, Shipping policy and Privacy policy. Questions can be sent to support@wearotherwhen.com.
Using the store
You must have the legal capacity to enter into a purchase contract. If you are under the legal age to do so, a parent or guardian must make the purchase on your behalf.
Please provide accurate contact, billing and delivery details. If you create an account, keep your login details secure and let us know if you believe someone has accessed it without permission.
You must not use the store for fraud, unlawful activity, harassment or infringement of another person's rights. You must not introduce malicious software, attempt to access systems without authorisation or interfere with the operation of the website.
Products and descriptions
We aim to describe our watches accurately. Read the product description and select your intended model and colour before completing your order.
Screen settings and lighting can affect how colours and finishes appear. Images may show styling or presentation settings; accessories are included only where the product description says so. These statements do not excuse a material difference between the goods supplied and their description.
Products must meet the standards required by applicable consumer law, including being of satisfactory quality, fit for purpose and as described.
Prices and payment
Prices and the transaction currency are shown in the store and at checkout. The checkout summary shows the amount payable to OTHERWHEN, including any taxes and shipping charges collected by us. Cross-border customs charges payable separately are explained in our Shipping policy.
Your payment provider may apply its own currency conversion rate or fees. Available payment methods are displayed at checkout.
We may change prices or promotions for future purchases. Changes do not retrospectively alter an accepted order.
Orders and acceptance
Submitting an order is an offer to buy the selected products. The initial order confirmation acknowledges receipt of your order; our acceptance takes place when we send a dispatch confirmation, unless we expressly confirm acceptance earlier.
Before accepting an order, we may decline it if an item is unavailable, payment cannot be authorised, there is a material pricing or description error, or we reasonably suspect fraud or unlawful use. We will notify you and refund any payment taken for an order we do not accept. We will not substitute a different product or increase an agreed price without your consent.
If we discover a material error before dispatch, we will explain it and give you the opportunity to proceed on corrected terms or cancel for a refund. Once a contract has been accepted, your rights under that contract and applicable law remain in place.
Delivery and cancellations
Shipping arrangements and estimated delivery times are set out in our Shipping policy and any information displayed before purchase.
To request an order change or cancellation, email support@wearotherwhen.com. We will try to act before dispatch. If an order is already on its way, you can still exercise any applicable cancellation or return rights.
For consumer orders, responsibility for the goods passes on delivery into your physical possession, or that of a person you have nominated, subject to applicable law.
Returns and refunds
Our Return and refund policy explains change-of-mind returns, faulty or incorrect goods and refunds. That policy forms part of these terms.
No provision in these terms removes or limits your statutory cancellation rights or remedies for faulty, damaged, misdescribed or undelivered goods.
Website content
The OTHERWHEN name, logos, photographs, copy and other website content are owned by us or used with permission. You may view the website and save information for your personal shopping use. Commercial reproduction or use of our content requires permission from the relevant rights holder.
You may not submit content that is unlawful, misleading, abusive or infringes someone else's rights. If you submit a review, it should reflect your genuine experience. We will obtain any permission required before using private customer correspondence in marketing.
Third-party services and links
The website may offer services or links provided by third parties, including payment services. Their own terms and privacy notices may apply to your use of their services.
A link does not mean we endorse all content on a third-party website. Our use of third-party fulfilment, payment or technology providers does not remove our obligations to you as the seller.
Availability and liability
We take reasonable care in operating the store but cannot promise uninterrupted website availability. We may temporarily suspend access for maintenance, security or circumstances beyond our reasonable control.
Where we breach these terms, we are responsible for loss or damage that is a foreseeable result of that breach, subject to applicable law. For consumer purchases, we do not accept liability for business losses arising from use of goods bought for personal purposes, to the extent the law permits.
Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited. Your consumer rights are preserved.
Privacy
Our Privacy policy explains how personal information is collected, used and shared. It takes priority over these terms on questions concerning the handling of personal information.
Changes to these terms
We may update these terms for future use of the store and future orders. The version in force when your order is accepted applies to that purchase. Changes will not reduce rights under an existing contract without your agreement where required by law.
If a provision is unenforceable, the remaining provisions continue to apply where possible. A delay in enforcing a right does not mean that right has been waived.
Applicable law and complaints
These terms are governed by the laws of England and Wales. If you are a consumer living elsewhere, this does not deprive you of mandatory protections or court rights provided by the law that applies where you live.
If something is wrong, contact support@wearotherwhen.com so we can try to resolve it. This does not prevent you from seeking other remedies available under applicable law.
